Lack of security management processes lead to a $400,000 fine

Metro Community Provider Network (MCPN), a federally-qualified health center in the Denver, Colorado area, has agreed to pay a settlement  of $400,000 and adopt a corrective action plan for alleged violations of the HIPAA Privacy and Security Rules. Despite taking the necessary corrective action related to the phishing scam, OCR’s investigation revealed that MCPN failed to conduct a timely risk analysis  . Furthermore, OCR discovered that, prior to the breach, MCPN had not conducted a risk analysis to assess the risks and vulnerabilities of its ePHI environment. When MCPN finally conducted a risk analysis, that risk analysis was insufficient to meet the requirements of the Security Rule. This settlement highlights the importance of workforce training to avoid phishing scams and conducting a timely and thorough risk analysis.
